Lending Library Borrower’s Agreement
We are pleased you would like to become a member of Witton Lodge Community Association’s Lending Library. We would like you to read and sign up to our Borrower’s Agreement before borrowing any items.
Introduction:
The person signing this agreement and the organisation on whose behalf the equipment lending is being made (collectively the “Borrower”) are responsible for compliance with this agreement. All Borrowers are required to read and sign this agreement.
Membership:
We welcome all residents to become members of the Lending Library. Members must be 18 years old or over to borrow items and tools (we will request proof of ID). If you are under the age of 18 we will need your parent or guardian to register with us.
Borrowing items:
- Items can only be borrowed for personal use.
- There are certain items that can only be borrowed for one week at a time.
- Items cannot be borrowed for a continuous period that exceeds three months.
- You can borrow an unlimited number of items, however you can only borrow a fixed number at any one time. You will be able to borrow more items when you have returned previously borrowed items.
- If you are borrowing an expensive item we will ask you to pay a small damage/security deposit up to 10% of the value of the item.

Returning items:
- Items must be returned clean and ready for the next borrower.
- All items to be returned in the same condition as they were issued, barring normal wear and tear. Any damage to the item must be reported so that we can assess the repairs that need to be carried out.
- Items must be returned by the close of business on the Return Date or before to enable others to borrow the item.
- You can change your Return Date online via your myTurn account, provided that:
Ø there are no reservations made by another Member starting on or before your new proposed Return Date
Ø you make the change before close of business on the stated Return Date
Ø the new proposed Return Date is not more than three months after the first date you borrowed the item
- If you are unable to return an item for any reason, you must contact us immediately.
- Repeated late returns may affect your future ability to borrow and/or result in us stopping the membership.
· All items will be cleaned before they are loaned out and cleaned after they are returned.
Using and Storing Items:
- When items are in our possession, we will take reasonable steps to ensure that items are safe and fit for purpose. We will make regular inspections of the items, carry out PAT testing, and repair the items when necessary.
- When you borrow items from us, you must take reasonable measures to keep the items safe and to protect them from theft, damage and/or other risks.
- Before using an item, you must check that the item is safe to use and the environment in which it is intended to be used is free from any potential hazards.
- If you are borrowing electrical equipment, you must check the visible wires and plug for any damage before use.
- Items must be used in a safe and proper manner.
- You are responsible for using any item you borrow only for the job it is intended to do, taking appropriate precautions and wearing personal protective equipment where necessary.
- Familiarising yourself with how to use the item, by reading the how-to guides, safety instructions or user manuals and watching YouTube videos where appropriate.
- You should not borrow or use any item if you are not confident with operating it safely.
- Immediately stop the use of an item if it becomes unsafe or in a state of disrepair and notify us of the problem as soon as possible. Do not attempt to repair or allow any third party to repair any item.
- If you are hosting an event using an item borrowed, you should obtain your own public liability insurance.
- If we discover you are not respecting the rules of borrowing and our guidance in how to use items in a safe and proper manner, we reserve the right to stop your membership at any time.
- If you are using the item outside, moving it about, or using it in circumstances where it may encounter water, anything sharp or other electrical wiring, you must use a circuit breaker.
Liability:
Subject to point (A) below:
- You agree that Witton Lodge Community Association is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any that you may be able to identify before using it. After carrying out a careful inspection, you should not use any items which appear to have a fault and should instead notify us immediately.
- We only supply the items for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- As a member, you will be responsible for and hold Witton Lodge Community Association harmless against all damage which you could have avoided by following our advice or the instructions, how-to guides, safety instructions or user manuals relating to the items.
· If you are borrowing an item on behalf of another person, it is your responsibility to ensure that that person is following the Borrowing Agreement.
(A) Nothing in this agreement limits any liability that cannot be legally limited, including death or personal injury caused by negligence and fraud or fraudulent misrepresentation.
DECLARATION
I have read and fully understand the Borrower’s Agreement and I understand that failure to comply with any of the points above may result in my membership being stopped.
I confirm that the information that I have provided on the Membership Application Form is current, true, and correct to the best of my knowledge. I understand that this information may be subject to verification.
I have read and understand this agreement and agree to the conditions of use.
